With that, Ted Stevens turned, smiled, and returned to his seat.

“Thank you, sir,” Judge Sullivan sincerely replied. Then the judge looked at Brendan Sullivan again. “Mr. Sullivan, you got away from the podium without me asking you one question. . . . On October 28, the day after the verdicts were returned, you delivered a sixteen-page letter to then-Attorney General Michael Mukasey, detailing at length many of the events recited today and asking the attorney general to commence a formal investigation into the prosecutorial misconduct in this case. Did you ever receive a response?”

Brendan Sullivan stood in place and responded with painful clarity. “Your Honor, I had actually sent three letters to the Attorney General of the United States, Mr. Mukasey. I never received an acknowledgment that they were even received in the office. I received no word back.”

Judge Sullivan coldly replied. “Shocking.”

After thanking all his clerks and staff, Judge Sullivan unsealed all bench conferences during the trial and made them part of the public record.

Then came a real shocker. “Finally the court has repeatedly been told that the Office of Professional Responsibility at the Department of Justice is conducting an investigation into the investigation and prosecution of this case. . . . That was six months ago. The court next heard about the OPR investigation when the government assured the court that it need not take any action based on the Joy complaint because OPR was conducting a thorough investigation. That was four months ago. And yet, to date, the silence has been deafening. Similarly the defense tells us just moments ago they received no response to their numerous letters to former Attorney General Mukasey urging him to commence a formal investigation.” He referred to this irrefutable fact as “shocking, but not surprising. . . .”

Judge Sullivan was not going to let this go unanswered. He said “the events and allegations in this case are too serious and too numerous to be left to an internal investigation that has no outside accountability. This court has an independent obligation to ensure that any misconduct is fully investigated and addressed in an appropriate public forum.”

Judge Sullivan paused to breathe—and for effect. Anyone taking notes stopped and looked up. The air seemed to have left the room. The prosecutors could hear their own hearts beating and feel their temples throbbing. No one saw this coming.
